Please read these Terms carefully before using our Services. These Terms contain important provisions, including that subscriptions may automatically renew until canceled, a mandatory binding individual arbitration agreement and waiver of class actions, and limitations on our liability.

Not for emergencies. The Platform and Services are not intended for medical emergencies. If you believe you are experiencing a medical emergency — including chest pain, difficulty breathing, signs of stroke, severe allergic reaction, suicidal thoughts, or any condition you believe is life-threatening — call 911 or go to the nearest emergency department immediately. In a mental health crisis, you may also call or text 988 to reach the Suicide and Crisis Lifeline.

These Terms of Service (the “Terms”) form a legally binding agreement between you and Vials & Vitals (“Vials & Vitals,” “we,” “our,” or “us”). The Terms govern your access to and use of the website at vialsandvitals.com, any associated domains or mobile applications, and the administrative coordination services we make available (collectively, the “Platform” or “Services”). By creating an account, clicking “I agree,” proceeding through checkout, or otherwise accessing or using the Services, you confirm that you have read these Terms, that you understand them, and that you agree to be bound by them. If you do not agree, you may not use the Services. The Privacy Policy, Telehealth Informed Consent, any payment and billing terms, refund policy, SMS terms, offer terms, and program disclaimers made available by Vials & Vitals are incorporated into these Terms by reference and form part of our agreement with you.

“Platform” or “Services” means the website, intake flows, patient portal, communications, administrative coordination, and related services made available by Vials & Vitals. “Provider Group” means the licensed professional entity or entities that deliver clinical services to patients through the telehealth platform coordinated by Vials & Vitals, and the individually licensed clinicians employed or contracted by such entities (each, a “Provider”). “Pharmacy” means a state-licensed pharmacy engaged through the telehealth platform’s pharmacy network to dispense medications prescribed by a Provider. “Medication” means any prescription drug, compounded preparation, or related product coordinated for you through the Services. “You” or “Patient” means the individual using the Services or, where permitted, a legal representative acting on that individual’s behalf.

You must be at least eighteen (18) years of age. The Services are not directed to and are not intended for individuals under 18. You must be a resident of the United States and physically located in a state or jurisdiction where the Provider Group is licensed to provide care. You must have the legal capacity to enter into a binding contract and not be prohibited from using the Services under the laws of your jurisdiction. You must provide accurate, current, and complete registration information and keep that information updated. You must be authorized to use any payment method you provide.

Vials & Vitals is a management services organization. Our role is to coordinate non-clinical administrative, marketing, technology, and support services that connect patients with independently licensed clinicians and pharmacies. Vials & Vitals does not practice medicine, nursing, pharmacy, or any other licensed healthcare profession; Vials & Vitals does not prescribe, diagnose, compound, dispense, or fulfill prescriptions; and Vials & Vitals does not direct, control, or interfere with the clinical judgment of any Provider or the professional judgment of any Pharmacy.

Vials + Vitals connects patients with licensed providers for telehealth evaluations. Compounded tablet medications are prepared by licensed pharmacies and are not FDA-approved brand products.

Medical provider partners

We are partnered with DrTelx (drtelx.com), an independent telehealth medical group whose providers are licensed in the states where we offer care. We work exclusively with licensed U.S. pharmacies that meet rigorous regulatory and quality standards. Our pharmacy partners include EPIQ Scripts, Foothills Pharmacy, and Emerald Compounding Pharmacy. Every pharmacy in our network is licensed in the states where it dispenses, accredited by the National Association of Boards of Pharmacy (NABP), board-certified, and LegitScript-approved. All prescriptions are filled and shipped by these licensed U.S. pharmacies in compliance with applicable state and federal law.

Our telehealth services are available to patients located in all 50 U.S. states and the District of Columbia. All consultations are conducted by licensed U.S. healthcare providers, and all prescriptions are dispensed by licensed U.S. pharmacies. Treatment is only provided where clinically appropriate and permitted by applicable state and federal law. Availability of specific medications may vary by state based on state regulations and provider licensure. Asynchronous (online questionnaire) care is available in the following 44 states: AK, AL, AR, AZ, CA, CO, CT, DE, FL, GA, HI, IA, ID, IL, IN, KY, MA, MD, ME, MI, MN, MO, MT, NC, ND, NE, NH, NJ, NV, NY, OH, OK, OR, PA, SC, SD, TN, TX, UT, VA, VT, WA, WI, WY. A live (synchronous) consultation with a provider is required before treatment in these 7 jurisdictions: District of Columbia (DC), Kansas (KS), Louisiana (LA), Mississippi (MS), New Mexico (NM), Rhode Island (RI), West Virginia (WV).
